This traumatic brain injury case was heavily contested on liability grounds with a fantastic result for the client. The incident occurred when the plaintiff was returning home from work to his apartment complex; he saw a parking space on the opposite side of the street, made a U-turn, and was struck by the defendant driver who was speeding. Plaintiff suffered a traumatic brain injury from the crash. Liability was heavily fought in this case, as the Plaintiff had alcohol in his blood at the time of the crash, and allegedly made an illegal/unsafe U-turn. Brian J. Kim and the trial team were undeterred, however, and took the case to verdict. On heavy cross examination, the Defendant’s expert eventually admitted that if the entire crash would have been avoided if the Defendant driver had simply been driving the speed limit. Brian J. Kim was an integral member of the trial team that achieved this incredible jury verdict.
