This was a disputed liability case where the client was struck from behind by a box truck while pushing his disabled vehicle on the freeway as a pedestrian. As a result of the crash, the client nearly lost his leg and was at risk for amputation. The principal issue in the case involved the client’s ability to collect noneconomic damages (pain and suffering) based on Prop 213 (no insurance). Through patience, persistence, and perspiration, the litigation team was able to circumnavigate the Prop 213 issues and establish the client’s compliance with California’s financial responsibility laws. Once it became clear that the client’s claims for general damages were alive and well, the defense caved shortly thereafter and offered $11 million to settle the case.
