This case involved a storefront vehicle crash of a man who was struck while sitting on a bench outside of a pharmacy store owned by one of the largest pharmacy store chains in U.S. Unbeknownst to everyone except the defendant, the pharmacy store chain was experiencing vehicle strikes due to pedal/operator error at its stores on a nationwide level almost daily. Because this was a known occurrence, the defendant implemented a mandatory safety policy requiring that protective pipe bollards be placed in between parking spaces and benches. This safety standard was implemented at all of defendant’s stores nationwide except for the pharmacy store where the client was struck. Due to the unprotected bench, the victim was struck by a vehicle when its driver, like thousands of drivers before her, inadvertently pressed the gas pedal instead of the brake. As a result of the crash, our client suffered a traumatic brain injury. After years of litigating this case across the country, the litigation team obtained a settlement in the amount of $12.5 million.
