This was a road rage incident that resulted in a moderate traumatic brain injury to our client. The tricky part about this case is that the at-fault driver’s vehicle never made physical contact with our client’s vehicle; nonetheless our client crashed his vehicle as a result of the incident. The at-fault driver then fled the scene, to further complicate matters. The uninsured motorist insurance on our client’s vehicle originally denied the claim based on an exclusion. However, the fine print and case specific facts revealed potential loopholes. Recognizing this as a high-risk case, our team quickly got the case to a fantastic mediator and they reached an excellent settlement.
